Jharkhand Government Introduces Sweeping Anti-Cheating Bill

In a resolute effort to curb the rampant use of unfair practices and irregularities in competitive examinations, the Jharkhand government is all set to introduce a groundbreaking legislation - The Jharkhand Competitive Examination (Measure for Control and Prevention of Unfair Means in Recruitment) Bill, 2023. The proposed bill aims to tackle issues like question paper leaks and ensure a level playing field for aspirants seeking government jobs.
One of the primary objectives of the proposed Bill is to enforce time-bound and transparent competitive examinations for government job recruitment. By imposing severe penalties on wrongdoers, the government aims to create a strong deterrent against engaging in unfair means during examinations.

Stringent Penalties for Offenders

Under the provisions of this soon-to-be-tabled Bill, those found guilty of participating in malpractices within the examination process, including printing of question papers and employees of examination authorities, could face imprisonment for life, coupled with fines of up to Rs 10 crore. The legislation demonstrates the government's firm stance against any form of cheating or manipulation in the examination process.

Inclusive Coverage of the Bill

The scope of the Bill extends beyond just the examinees and encompasses various individuals and entities associated with the examination process. This includes those working at printing presses responsible for producing question papers, service providers, employees of examination authorities, and even individuals linked to coaching centres.

If found involved in conspiracies related to irregularities, these individuals could face imprisonment ranging from a minimum of 10 years to life, along with a hefty fine of up to Rs 10 crore.

Stringent Measures Against Examinees

The proposed legislation does not spare examinees who resort to cheating. Any examinee caught with unauthorized access to question papers, attempting to leak them, impersonating, or tampering with computers to gain an unfair advantage could face serious consequences. 

Such actions could lead to debarring the individual from participating in competitive examinations held by the examination authority. Furthermore, repeat offences could result in an examinee being barred from competitive exams for up to 10 years or even a lifetime.

JPSC Controversies Fuel the Need for Stricter Legislation

The Jharkhand Public Service Commission (JPSC), responsible for conducting the Combined Civil Service Examination, has faced persistent controversies since the inception of the state in 2000. With all seven examinations conducted by JPSC marred by allegations of irregularities, confusion, and corruption in the selection process, the need for a robust legal framework to deter such practices has become imperative.
